1. DEFINITIONS

First, we are going to show you the definitions of some terms that will appear throughout this document.

1.1 - PERSONAL DATA: information related to an individual that makes him directly identified or identifiable;

 

1.2 - SENSITIVE PERSONAL DATA: personal data on racial or ethnic origin, religious belief, political opinion, union membership or organization of a religious, philosophical or political nature, data relating to health or sexual life, genetic or biometric data, when linked to an individual;

1.3 - HOLDER: natural person to whom the personal data that are the object of treatment refer;

1.4 - TREATMENT: any operation performed with personal data, such as those referring to the collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, filing, storage, disposal, evaluation or control of information, modification , communication, transfer, diffusion or extraction;

1.5 - ANONIMIZATION: use of reasonable and available technical means at the time of treatment, by means of which a data loses the possibility of association, directly or indirectly, with an individual;

1.6 - CONSENT: free, informed and unequivocal manifestation by which the holder agrees with the treatment of his personal data for a specific purpose;

2. INFORMATION WE COLLECT

Now that you know what we are talking about, we will explain to you what are the personal data we collect, remembering that we only work with that information essential for the purposes of our website, being certain that other information can be collected and processed before the imposition of rules that apply to our services, as well as through your consent.

2.1 - Data Provided by the User:

a) Registration Data on the Site: name, physical address, telephone number and. email. We may eventually request your ID number (eg ID, passport, etc.), CPF number and date of birth, when applicable.

This information is collected so that we can register on the Site and enable the purchase and delivery of the chosen products.

2.2 - Data Collected by the Site:

a) Location Data: When the Site is running, we will collect information related to your location through the GPS of your device, as well as through the IP address and the mobile and / or wireless network.

b) User Profile: When the Site is being used by you, we will collect information about how you use our platform, such as most accessed pages, dates and times of access and other information related to your use.

This information will be collected in order to guarantee the constant quality of the functionalities existing on the platform.

c) Transaction data: BM will not keep credit card data used to pay for services, as well as bank details. However, we will keep a hash code with the information of the transactions, such as date and time of payment.

d) Electronic Device Data: When using the Site, data related to the electronic device you are using will be collected, such as brand, model, IP address, operating system, IMEI, mobile network data, among others.

This information will be collected in order to adapt the functionality of the platform to the device being used by the User.

e) Use of Cookies: When using the BM website, browsing data will be collected through cookies, which will be maintained with the BM.

This information will be collected for advertising campaigns with users, such as promotions and discount codes.

3. DATA SHARING

As you already know what types of information we collect, you may now have a question: “is BM going to share my data with someone else and / or a company?”. And in this session we are going to answer that question.

As we said at the beginning, the privacy of our Users is a constant concern. Therefore, we will not share your data with third parties, except in the cases below. It is important to remember that, in such cases, whenever information security depends on BM, we commit to using our best efforts to keep your data safe.

a) Sharing with the consent of the holder: your data will be shared whenever you expressly request and / or authorize us to do this operation;

b) Sharing with companies in the same economic group: we may share your personal data with companies that are part of our economic group, such as subsidiaries, affiliates, affiliated companies or controlling entities .;

c) Sharing with public bodies and public entities: we may share your data with public bodies and public entities (ANVISA, PROCON, etc.) to meet legal and / or regulatory obligations that are imposed on the services we provide, as well as to comply with court orders eventually imposed;

d) Sharing with police authorities: we may share your personal data and other information that we deem necessary if, at BM's discretion, there is suspicion of the commission of any act considered a crime or a criminal offense, under the terms of the law. In this case, the existence of a legal and / or regulatory obligation, as well as a judicial order, will be expressly waived;

e) Sharing with service providers and business partners: we may share your personal data with service providers and business partners, such as companies that function as means of payment and user relationship tools;

Since you already understand what data we collect and under what circumstances we will share that information, it is time to find out how we will keep your data safe and secure.

We use the most modern information security systems in all our systems and devices, which includes the use of technological tools such as cryptography, access controls, firewalls, creation records and account access, among others.

It is important to remember that we only apply these layers of security from the moment that your information is received by BM and while they are kept with us. Therefore, we cannot guarantee the security of the electronic device or the networks you are using to access our platform.

But while we use our best efforts to protect our users' data, we know that incidents can happen. 5. RIGHTS OF PERSONAL DATA HOLDERS

As the owner of your own personal data, you have several rights that can be exercised at any time and upon a direct request directed to BM. Below, we will explain each of these rights, demonstrating our commitment to transparency:

a) Confirmation of the existence of treatment: you can send us a request to confirm whether we are carrying out any type of treatment related to your personal data, as well as what data we have about you;

b) Access to data: in addition to confirming that we are processing your personal data, you can also request access to all data that we have about you;

c) Correction of incomplete, inaccurate or outdated data: if you find that your data is incomplete, wrong or outdated on our platform, you can ask us to correct the information;

d) Anonymizing, blocking or eliminating unnecessary, excessive or treated data that does not comply with the law: if you understand that we are treating data in an excessive way about you, you can request that we perform the anonymization, blocking or elimination of this information. Regarding this right, it is important to remember that we will first carry out a consultation to verify that we do not really need the data that was collected;

e) Data portability to another service or product provider: if you choose to use any competing service from BM, you can ask us to send all of your information that we have with us directly to this new platform. However, we will preserve trade and industrial secrets that may be involved in operations;

f) Elimination of personal data treated with the consent of the holder: if you have provided us with your consent for the processing of your personal data, you can request the elimination of that same data, except when we have to keep this information, under the terms of the law, opportunity in which we will inform you about it;

g) Information on public and private entities with which we share your data: you can ask us for details on which public bodies and / or companies we share your personal data with;

h) Information about the possibility of not giving consent and about the consequences of the refusal: whenever we need your consent for the processing of your personal data, we will inform you about the possibility of not giving us this authorization, as well as what it can do entail;

6. MAINTENANCE AND EXCLUSION OF PERSONAL DATA

We will keep your information with us as long as you maintain your account on our platform (which we hope will last for a long time!). If you choose to close your account, you can request the deletion of your personal data directly on our communication channels.

We also remind you that, even with your request to delete the data, we may keep some information with us, under the terms of the legislation in force. In that case, we will inform you about it. In addition, we may keep your data with us anonymously and for the exclusive use of BM.
